Introduction

Aylo Freesites Ltd (hereinafter “we”, “us” or “our”) operates the website www.pornhub.com (hereinafter “Pornhub”) and is the controller of the information collected or provided via Pornhub.

Please read this Privacy Notice carefully, as your access to and use of Pornhub signifies that you have read, understood, the terms set forth in this Privacy Notice. This Privacy Notice explains how we collect, use and disclose information from individuals who visit Pornhub. We respect your privacy and are committed to protecting your personal data.

1. Scope

For the purposes of this Privacy Notice, “process”, “processed” or “processing” means any operation or set of operations performed on personal data or on sets of personal data (excluding disclosure thereof), whether by automated means, including one or several of the following operations: collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, alignment or combination, restriction, erasure, or destruction. Information on disclosure of personal data or of sets of personal data may be found in the “Disclosure of Your Personal Information” section below.

This Privacy Notice applies to information we process:

• on Pornhub; and

• on your communications with Pornhub via email, online support chats, phoneline support or otherwise.

2. Our Policy Towards Minors

Pornhub prohibits minors from using the platform. Pornhub is forbidden for persons under the age of 18 and the applicable age of majority in the jurisdiction from which Pornhub is accessed. As indicated throughout this Privacy Notice, some users may be asked to provide some information to us and our service providers for us to make sure that you are over the age of majority required to have access to the Pornhub. We do not intend to process minors’ Personal Data (as defined under section 3 below). However, we and/or our service providers, could incidentally process Personal Data related to minors when carrying out our age verification process, in strict accordance with the locally applicable legal obligations which Pornhub is subject to (for more details regarding the type of Personal Data processed in this context, refer to section 3 below “Identifiers”). If you are the parent or legal guardian of a minor who has provided us with personal information, then please contact us at [email protected] to have that minor’s Personal Information deleted. 

3. The Data We Process About You

“Personal Data” or “Personal Information” refers to any information relating to an individual that can be used to identify that person, either directly or indirectly. This does not include data that has been anonymized or aggregated in such a way that the individual is no longer identifiable.

We may process different types of Personal Data about you, depending on whether you choose to create an account on Pornhub.

 Unregistered Users 

We process the following categories of information for individuals who visit Pornhub without logging in or creating an account:

• Contact Data: We will only process your email address or any other information which you voluntarily provide to us at your direction for a specific function, namely, such as to participate in a contest or survey.

• Online Forms and Communication Data: We process Contact Data and other information that you submit through online forms provided on Pornhub or information you send to us via email, online support chats or otherwise such as information provided in the context of support requests or any other inquiries, the content reporting and moderation of content, and our internal complaint handling system. 

• Website Activity data: We process information about how you use Pornhub, products and services and interact with content and advertisements, including the pages you visit and search history on Pornhub, and the referring web page from which you arrived on Pornhub. We process browser and operating system information, devices you use to access Pornhub, your time zone setting and other information we collect through the use of cookies and similar technologies, such as online identifiers and internet protocol (IP) address information, as explained below in the section on Cookies and Automatic Data Processing Technologies.

• Identifiers:  You may be asked to provide identifiers (including government-issued photo identification as well as other documentation) to verify that you are over the age of majority required to have access to Pornhub and to view their contents. In such cases, this information is processed by trusted third-party age verification service providers. This Privacy Notice does not apply to the privacy practices of these third-party age verification service providers. Read the privacy terms and conditions of these third-party service providers carefully.

Registered Users

Individuals who choose to create an account on Pornhub will have the same categories of information processed as described above for Unregistered Users. In addition, we process the following information specifically for Registered Users:

• Contact Data: We process usernames, and email addresses. If you choose to register through a third-party platform, we will collect certain personal information from those platforms.

• User Submitted Personal Information: We process information you submit for a specific function, for example date of birth, feedback, as well as any other information which you voluntarily provide to us at your direction for a specific function.  

• Identifiers and Biometric Information: If you choose to register as a Registered User on Pornhub, or if this is required for age verification purposes, we process the identifiers you submit to us (including government-issued photo identification and other documentation) to verify your age and/or identity, as well as to confirm eligibility. Additionally, and if applicable in your jurisdiction, our third-party service provider will process face recognition data, which is considered biometric information, to verify your age. See the section “Biometric Information” for more details

• Sensitive data: Depending on how you use Pornhub, we might collect special categories of Personal Information concerning your sex life or your sexual orientation. 

• User Contributions, including posts and private messages: We provide areas on Pornhub where you can post information, communicate with others(e.g. private messages) , and post comments or reviews. Depending on the feature you use, some User Contributions may be publicly available through the Website, while others, such as private messages, are only accessible to the intended recipient. Please use caution when providing User Contributions.  

• Action History Data: We will process information about your activity on Pornhub, including the actions you take, the time of each action and the data retained. We will also keep records of the first and most recent times you accessed your account, and information relating to your country of access or origin.

Pornhub Models and Co-Performers

Individuals who choose to create a verified Model account and/or are a Co-Performer on Pornhub will have the same categories of information processed as described above for Unregistered and Registered Users. In addition, we process the following information specifically for Pornhub Models and Co-Performers:

• Model Application Data and Performer Consent Form:  We process legal name, date of birth, phone number and physical address (address, zip code, city, country) that you provide through Model application process and for Co-Performers, on the Performer consent and release form. 

• User Submitted Personal Information: We process information you submit to personalize your account or for a specific function, for example stage name, relationship status, and body measurements, content, such as images and videos, in the context of your Model profile completion and functionality or if you are a Co-Performer, information the Model submitted for you when adding you to their account as a verified Co-Performer and/or uploading content in which you are featured. 

• Uploaded Content: We process Personal Data contained in content you upload to Pornhub, including videos or images and any other materials you choose to upload. By providing Uploaded Content you are making it and any information provided herein available to the Website. Uploaded Content can be read, collected, used, and disclosed by others, and we cannot control who accesses it or what other users may do with the information you voluntarily post or submit. Uploaded Content is governed by the Pornhub terms of use found at https://cpb807.top/information/terms.

• Sensitive data: We might collect special categories of Personal Information including  your sexual interests, your ethnicity, in the context of your Model profile completion and functionality and/or Performer appearance in content published by a Model on our Website.

• Transaction data (for Models only): If you receive payments from us, we collect payment card or account details and related information, such as your Tax Identification Number, necessary to process payments and remain compliant with tax regulations. We also collect details about payments to and from you and details of products and services you have purchased or received from us and any failed payments. Any payments you made are processed by our third-party payment providers. We do not process your full payment card number, payment card expiration date, or the security code.

• 2257 Records and Audit Data: We may collect and process 2257 Records, consent and release forms and other age- and identity-verification information relating to individuals appearing in content uploaded to the Model channel to investigate content removal requests, conduct audits in accordance with the Model Program Additional Terms and Conditions or as may be required by applicable law. This may include government-issued identification documents, legal names, aliases or stage names, dates of birth, email addresses, images and videos, and records linking individuals to specific content or productions.

4. The Sources from Which We Process Personal Information

We process Personal Information in the following ways:

• Directly from you: We process the categories of information listed above directly from you.

• From Models and Content Partners: In the case of a Co-Performer and Individuals Appearing in Pornhub Content Partners’ content, information can be collected from the Models or Content Partners appearing in the videos.

• Automated technologies or interactions: As explained in the section below on Cookies and Automatic Data Processing Technologies, we set cookies and other automatic techniques to process website activity data when you visit Pornhub.

• Third-Party Single Sign-on: We may obtain information if you choose to create or sign-in your account through a third-party platform if available, we will have access to certain information from that platform such as your name, email address or such other information you may have submitted and allowed this third party to share.

5. Purposes for Which We Process Your Personal Information

We process personal information for the purposes described below.

• Provision of services: We process Identifiers, Website Activity Data, Contact Data (if voluntarily submitted as described hereinabove) and, additionally for Registered Users and Models  only,  User  Submitted  Personal  Information,  User  Contributions  and Upload Content, including any interactive features on Pornhub, to provide products or services that you request. 
• Customer management and quality assurance (Unregistered Users excluded): We process Identifiers and Contact Data to manage Registered Users’, Models’ and Content Partners’ account, to provide customer support and notices to them about their account, and to provide notices about changes to Pornhub or any products or services we offer or provide. Additionally, we may process Contact Data and Online Forms and Communication Data for training our customer support teams, quality assurance purposes, and to improve the quality of our customer service interactions.
• Business Verification (Content Partners Only): If you will be managing Content on behalf of one or more Content Partners  or Agency or are applying to Content Partner Program on behalf of a company, we process Content Partner Application Data  to complete the business verification process through third-party verification providers. 
• Age and identity verification: In some cases, we process Identifiers and Biometric Information (including government-issued identification that may be considered sensitive data) and will use third party service providers to process sensitive data, including biometric information for the purpose of verifying your identity and the authenticity of the identifiers you provide to us while registering on Pornhub.
• Customization of content and marketing: We process  Website Activity Data  (for  Registered, Unregistered Users and for Models) and User Submitted Personal Information and User Contributions (only for Registered Users and Models) to analyze your use of, or interest in the content, products, or services, to display content and advertising tailored to your interests on Pornhub. 
• Communication and handling of requests: We process Online Forms and  Communication Data and other information necessary to respond to and resolve any of your requests, including, where this is required, to ensure compliance with our legal obligations. 
• Analytics: We process Identifiers and Website Activity Data to determine whether users of Pornhub are unique, or whether the same user is using Pornhub on multiple occasions, and to monitor aggregate metrics such as total number of visitors, pages viewed, demographic patterns.
• Product improvement: We may process Website Activity Data,  User Submitted  Personal Information, and User Contributions to improve our products and services. 
• Fraud Prevention and Risk Management: We may process any of the categories of Personal Data mentioned herein to diagnose or fix technology problems, to detect, prevent, and respond to actual or potential fraudulent, illegal activities, unauthorized access, identity theft, or intellectual property infringement. This includes monitoring unusual patterns of behaviour, maintaining security of accounts, user authentication,  and transactions. 
• Platform safety: We may process any of the categories of Personal Data mentioned herein to promote safety and security on Pornhub. We use the information we collect to help protect Pornhub users from harm and provide safe, secure product.
• Compliance: We may process any of the categories of Personal Data mentioned herein to enforce this Privacy Notice, our Terms and Conditions and to comply with any applicable legal obligations, namely but not limited to responding to your data subject requests, to verify the age of users having access to Pornhub, to respond to content reports, and to comply with applicable content moderation and complaint handling obligations as well as obligations to provide information to researchers under the EU Digital Services Act (DSA). 
• Hash values: We may create hash values from any of the categories of Personal Data mentioned herein to, such as infringing or illegal content to detect, prevent, and combat illegal activities including fraud, sexual assault, or exploitation. We reserve the right to disclose any hashes with law enforcement agencies. 
• Business Operations and Administration: We may process Contact Data, Identifiers, Transaction Data, and Website Activity Data for internal business administration purposes, including accounting, auditing, recordkeeping, insurance purposes, corporate governance, reporting, and business planning.
• Legal Defense: We may process any of the categories of Personal Data mentioned herein to establish, exercise, or defend our legal rights in connection with actual or potential legal proceedings, disputes, or claims. This includes disclosing Personal Data to our legal counsel, courts, and other parties involved in legal proceedings where necessary to protect our interests or comply with legal processes.
• Business Transfers and Corporate Transactions: We may process any categories of Personal Data in connection with potential or actual mergers, acquisitions, divestitures, restructuring, reorganization, dissolution, or other sale or transfer of assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.
• Information you provide: We will process Contact Data and User Submitted Personal Information in any other way we may describe when you provide the information or for any other purpose with your consent provided separately from this Privacy Notice.

7. Disclosure of Your Personal Information

We disclose your personal information when necessary to perform the services or for other purposes set out in this Privacy Notice. When we disclose your personal information, we usually rely on the performance of our contract with you, our legal obligation to do so, our legitimate interest (e.g., operating Pornhub), so long as it doesn’t outweigh your interests or your consent, except when expressly stated otherwise below in the paragraph “To comply with the law or protect our rights or the rights of third parties”. Disclosure of your personal information may also involve transfers of your personal information outside the EEA. To the extent that we need to transfer personal information outside the EEA, we will do so according to the section “Transfers of Your Personal Information to Other Countries” or when necessary for the performance of the contract between us. The parties to whom we may disclose your personal information include: 

• The public:  When you submit User Contributions including posts and private messages or Uploaded Content, you are using Pornhub and services to make that information public.

• Our contractors: To provide our services to you, our contractors may receive access to your Personal Data only on a need-to-know basis. Such contractors abide by confidentiality obligations. 

• Our corporate group: We may disclose any of the categories of personal information that we collect to members of our corporate group      to the extent this is necessary for the purposes described in this Privacy Notice, and generally to operate our business, which includes: identification and age verification purposes, transaction monitoring and payment processing, customer support, facilitate business development, administer user accounts or provide IT, technical and engineering support. You acknowledge that in some cases, members of our corporate group might be established or run their services outside the EEA. 

• Linked Third-Party Websites or Single Sign-On (SSO) Services: You may choose to sign-in, connect or register an account using an external third-party platform, or Single Sign-On (SSO) if available. If you choose to connect your account to a third-party platform, the providers of this platform may receive information about you. When you use third-party platforms, their own terms and privacy policies will govern their use. 

• Service providers: We disclose certain categories of Personal Information to our authorized service providers (such as identity and age verification providers; hosting, infrastructure and content delivery providers; IT maintenance, performance monitoring and security providers; analytics and user experience providers; communication and email service providers; customer service and support platforms) to enable us to provide our services to you pursuant to our Terms & Conditions. These service providers may use your information only to perform these tasks on our behalf, such as identity and document authenticity verification including biometric processing, age verification, risk and fraud detection and mitigation, customer service, marketing and advertising, customization of content, analytics, security, hosting or supporting Pornhub ’s functionality. These service providers have limited access to personal information needed to perform their functions but are not permitted to process such information for any other purposes. • Legal successors: We may disclose all categories of personal information we process to a buyer or other successor in the event of a merger, acquisition or sale or transfer of some or all our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding. Such transactions may be in our legitimate interest, particularly our interest in making decisions that enable our business to develop. 

• Legal and Regulatory Recipients: We access, preserve and share Personal  Information with regulators, public authorities, law enforcement, government agencies, out-of-court dispute settlement bodies or other authorities. 

• Professional Advisors: legal counsel, accountants and auditors, tax advisors, business consultants.

• Researchers and Digital Services Coordinators: We share information with researchers where this is legally required to comply with data access requirements under the DSA. This may include all categories of personal data that are necessary for the purpose of conducting the research. For access requests by unvetted researchers, this is limited to information that is publicly accessible.

As you navigate through and interact with Pornhub, we use automatic data collection technologies to collect website activity data. The technologies we use for this automatic data collection include cookies and other similar technologies. We strive to provide you with choices regarding the personal information you provide to us.

• You can choose not to provide us with certain personal information, but that may result in you being unable to use certain features of Pornhub because such information may be required for you to create an account, use our products or services, participate in a contest, promotion, survey, or sweepstakes, communicate with our support teams, or initiate other activities on Pornhub.
• The Cookie Banner allows you to customize your cookie preferences and records your consent to our use of cookies. We will ask for your consent annually, or whenever we make significant changes to our cookies, to ensure you remain informed of any updates. The Cookie Banner controls the functionality, analytics, and advertising cookies used by Pornhub. Strictly necessary cookies cannot be disabled, and the Cookie Banner cannot be used to block cookies set by third-party websites linked from our website. You can access the Cookie Banner at any time by clicking the Manage Cookies option in the footer of the Pornhub website.  
• You may delete your account at any time, unless we are required to retain it by applicable law or a court order. Upon deletion, your account will no longer be accessible. However, we may retain certain information associated with your account for a limited period where necessary to comply, for example with legal obligations, resolve disputes or other legitimate business purposes permitted by applicable law. 
• Where we provide personalized services, we may analyze the information you supply, as well as your activity on Pornhub so that we can offer a more relevant, tailored service. For instance, we could use your favourites list to provide personalized content recommendations or ads. If you do not want to receive these services, you can switch off the recommendations toggle on the “recommended” page or via the bar at the left of our page. • You can opt out of receiving marketing emails from us using the opt-out link provided in our emails or by changing your preferences in your account settings if you are a Registered User. Please note that we may continue to send you other types of important emails, e-mails about your account.
• You may use your account settings to delete your user contributions and audio/video information.

12. Biometric Information

We rely on third-party service providers to verify your identity, age, and the authenticity of the identification documents you provide using facial recognition technology. Facial recognition technology creates a mathematical representation of your facial features from the live scan of your face, your selfie, and the government-issued ID you submit or previously submitted to us.  Face recognition data is collected by and remains with our third-party providers. We do not process face recognition data.

When applicable, your biometric information may be processed to:

• verify you are a real, live person and to prevent the use of methods which would allow a user to identify as someone else;

• to match your selfie with your government-issued ID you submit or previously submitted to us to make sure that nobody is impersonating you;

• to help confirm your age.

You will be asked to provide your consent to biometric information processing which you may withdraw at any time. Withdrawing your consent will not affect the lawfulness of any collection, use, processing, or disclosure that occurred prior to the withdrawal. We invite you to consult our third-party service providers’ privacy notices and terms and conditions.

The following information serves as a guideline for law enforcement officials seeking disclosure of records. You may serve us a valid court order, subpoena, search warrant or equivalent legal or official administrative document by respecting the following conditions:

• The document(s) is uploaded, and all required fields have been filed out adequately on our platform for Legal Service Process located at: https://legalservice.aylo.com/legal/datarequest;

• The document(s) you are serving is correctly issued to Aylo Freesites Ltd by a valid court of law or equivalent legal or administrative authority to us;

• The document(s) is also sent by mail at the following address: 195-197 Old Nicosia-Limassol Road, Block 1 Dali Industrial Zone, Cyprus 2540.

We reserve the right to refuse online service through Pornhub, namely in cases where the above requirements are not met and require formal legal service at the above address. In such an event, you will be notified. We may raise or waive any legal objection or right available, in our sole discretion.
